GENERAL TERMS AND CONDITIONS OF WEINBAU HOPFER

1. Scope

These general terms and conditions apply to the sale and delivery of goods by Weinbau Hopfer with its headquarters and business address in Pichla at Radkersburg 90, 8355 Tieschen. Unless expressly agreed otherwise, our general terms and conditions, which have been made known to the contractual partner, apply. The contract language is German.

 

2. Offer

Our offer is subject to change and is only valid while stocks last. Due to the limited quantities of individual goods, there may be a sell-out situation during your online order. In this case we take the liberty of offering you alternative products. Our current delivery and payment conditions are exclusively decisive for the delivery. Deviating agreements are only valid if they are confirmed by us in writing.

 

3. Order

3.1. The customer's order represents an offer. A contract is only concluded after acceptance on our part. The customer will be informed of our acceptance by email or phone. Should we not be able to fulfill the customer's order for any reason, the customer will be informed immediately.

3.2. Weinbau Hopfer accepts orders by phone (+43 664 1401433), email (kontakt@hopfer-weine.at) or via the internet online shop. When placing the order, the customer must give an exact delivery location. The customer is obliged to secure the ordered goods at the specified delivery location. Weinbau Hopfer sends the customer a written order confirmation with all relevant order data.

3.3. Orders are accepted subject to delivery options. Weinbau Hopfer reserves the right to allocate smaller quantities to the customer if a product is oversubscribed.

 

4th prize

4.1. All prices include the applicable VAT plus shipping costs. Unless expressly stated otherwise, the prices refer to the items shown as per the description, but not to accessories or decorations.

4.2. The prices are based on the costs at the time of the initial quotation. Should the costs change by the time an order is placed by the buyer, Weinbau Hopfer is entitled to adjust the prices accordingly.

4.3. The taxes are shown separately on the invoice.

 

5. Payment

5.1. Weinbau Hopfer retains ownership of all goods until the purchase price has been paid in full, including ancillary fees.

5.2. With the payment methods via Stripe and PayPal, payment is made immediately and before the order is received. For prepayment, the bank details are as follows: IBAN: AT26 3812 8000 0301 1186, BIC: RZSTAT2G128

As soon as we have received the confirmation or payment, the order will be sent to the specified delivery address.

 

6. Delivery

6.1. Weinbau Hopfer charges transport costs for each order quantity in addition to the prices indicated. The amount of the current transport costs is displayed during the ordering process as well as in the order confirmation. When the goods are delivered, use and risk are transferred to the buyer at the latest when they are handed over to the buyer or his representative.

6.2. For deliveries in European countries, additional delivery costs will be charged - these will be shown in the shopping cart after you have made the correct selection.

6.4. The delivery takes place via the Austrian Post (post.at) at normal business times. If the ordered goods are not accepted, Weinbau Hopfer is entitled to reimburse the additional expenses incurred, such as. frustrated transportation costs. This does not apply if Weinbau Hopfer does not provide its services in accordance with the contract.

6.5. Weinbau Hopfer can unilaterally change the stated amounts for future contracts at any time.

 

7. Transport damage

Weinbau Hopfer guarantees full replacement for damage and impairments that occur during transport under the following conditions: The incoming goods must be checked for correctness and completeness and notified immediately. Any complaints must be confirmed by the transport company.

 

8. Return of the goods

8.1. If the buyer is a consumer within the meaning of consumer protection laws and has placed his order by post, telephone, e-mail or via the Internet online shop, he can according to §§ 5e-5h of the Consumer Protection Act (KschG) within seven working days (Monday - Friday) declare withdrawal from the purchase contract from the day the goods are received by the buyer. The withdrawal does not require any justification, it only has to be sent in due time. The buyer will be reimbursed the purchase price already paid against the return of the goods, but has to bear the costs of the return. If the goods are returned freight collect, Weinbau Hopfer is entitled to withhold or invoice a corresponding amount. The return of the goods in the original packaging must be sent to the following address: Weinbau Hopfer, Pichla bei Radkersburg 90, 8355 Tieschen. In the case of articles that are impaired by signs of use, we will charge an appropriate fee for the reduction in value. The same applies if accessories or parts are missing when the goods are returned.

 

9. Warranty

9.2. Customary or minor, technically caused deviations in quality, quantity, color, size, weight, equipment or design do not constitute warranty defects or non-fulfillment of the contract.

 

10. Protection of minors

The sale and delivery of wine can only be made to people over the age of 18. In order to comply with the legal regulations, Weinbau Hopfer is entitled to hand over goods only after legitimation by means of an official photo ID. In the case of a justified refusal of handover, the customer is obliged to compensate for the damage actually incurred (e.g. costs of delivery).

 

11. EDP processing and customer data

The buyer agrees that the data specified in the purchase contract and disclosed during registration will be stored and processed in compliance with the provisions of the data protection act. These data are used to the extent necessary to meet legal requirements, to process payment transactions and to take care of customers. As part of customer care, Weinbau Hopfer does not pass on data to other companies.

 

12. Other provisions

12.1. If individual provisions of these general terms and conditions are invalid, this does not invalidate the entire contract. The rest of the contract remains unchanged.

12.2. The place of performance is the respective company headquarters. For all legal disputes, the contracting parties submit to the district court responsible for the company's headquarters regardless of the amount in dispute.

12.3. The contract is subject to Austrian law.

 

With the purchase, the customer declares himself to be in agreement with the applicable delivery conditions.
